Some policies and measures to support the healthy development of market players in Chengdu-Chongqing twin-city economic circle

In order to fully implement the "Planning Outline for the Construction of Twin Cities Economic Circle in Chengdu-Chongqing Region", fully stimulate the vitality of various market players in Sichuan and Chongqing provinces, and promote the healthy development of market players, the following policies and measures are formulated.

First, increase fiscal and taxation support.

(1) From April 1, 2022 to December 31, 2022, small-scale taxpayers of value-added tax shall be exempted from value-added tax for taxable sales income at the rate of 3%; Prepayment of value-added tax with 3% withholding rate is applicable, and prepayment of value-added tax is suspended. (2) Continue the policy of adding and deducting value-added tax in service industry. In 2022, the deductible input tax of taxpayers in production and life service industry will continue to be added and deducted by 10% and 15% respectively. (3) Fully implement qualified small and micro enterprises (including individual industrial and commercial households) and manufacturing, scientific research and technical services, electricity, heat, gas and water production and supply, software and information technology services, ecological protection and environmental governance, civil aviation transportation, warehousing and postal services, wholesale and retail, agriculture, forestry, animal husbandry, fisheries, accommodation and catering, residents’ services, repairs and other services, education, health and social work, and culture. (4) Increase the pre-tax deduction of equipment and appliances in small and medium-sized enterprises. Small and medium-sized enterprises can purchase new equipment and appliances with a unit value of more than 5 million yuan in 2022. If the minimum depreciation period is 3 years according to the tax law, they can choose to deduct the equipment and appliances before tax in the current year. If the minimum depreciation period is 4 years, 5 years and 10 years, 50% of the unit value can be deducted before tax in the current year, and the remaining 50% can be deducted before tax in the remaining years according to regulations. Losses caused by insufficient deduction in the current year can be carried forward and deducted in the next five tax years. (5) If the R&D expenses actually incurred in the R&D activities of small and medium-sized scientific and technological enterprises are not included in the current profits and losses, they will be deducted according to the actual amount from January 1, 2022, and then deducted according to 100% of the actual amount before tax; If intangible assets are formed, they will be amortized before tax according to 200% of the cost of intangible assets from January 1, 2022. (6) From January 1, 2022 to December 31, 2024, the part of the annual taxable income of small and meager profit enterprises that exceeds 1 million yuan but does not exceed 3 million yuan shall be included in the taxable income at a reduced rate of 25%, and the enterprise income tax shall be paid at the rate of 20%. (7) From January 1, 2022 to December 31, 2024, the resource tax (excluding water resource tax), urban maintenance and construction tax, property tax, urban land use tax, stamp duty (excluding stamp duty on securities transactions), farmland occupation tax, education surcharge and local education surcharge will be reduced by 50%. (8) According to the national deployment, on the premise of ensuring that all social insurance benefits are paid in full and on time, on the basis of implementing three social insurance premium policies for five extremely poor industries, such as catering, retail, tourism, civil aviation, highway, waterway and railway transportation, the scope of implementation will be further expanded, focusing on manufacturing enterprises whose industrial chain and supply chain are greatly affected by the epidemic and whose production and operation are difficult. All small and medium-sized enterprises and individual industrial and commercial households that have temporary difficulties in production and operation in areas seriously affected by the epidemic can apply for deferring the payment of three social security premiums. Institutions and social organizations such as social organizations, foundations, social service agencies, law firms and accounting firms participating in the basic old-age insurance for enterprise employees are implemented with reference to the three social security premium policies for small and medium-sized enterprises. (9) Where the provincial people’s congresses, governments, financial and tax departments are authorized by tax laws, regulations, rules and administrative normative documents to determine their own implementation standards, the financial and tax departments of the two provinces and cities shall establish a mutual notification mechanism and a difference coordination mechanism to appropriately unify the implementation standards of Sichuan and Chongqing provinces and cities. Ministry of Commerce: Promoting the development of cross-border e-commerce through taxation, supervision and facilitation.

  CCTV News:On April 10th, the State Council Joint Prevention and Control Mechanism held a press conference. Ren Hongbin, Assistant Minister of Commerce, and Li Xinggan, Director of Foreign Trade Department, introduced relevant measures to stabilize foreign trade and answered questions from reporters.

  Ren Hongbin, Assistant Minister of Commerce, introduced that in order to promote the development of cross-border e-commerce, the State Council has introduced a series of policies and measures to support enterprise development, mainly in three aspects:

  First, in terms of taxation, for the goods that the e-commerce export enterprises in the comprehensive test area have not obtained valid purchase vouchers, the tax exemption policies for value-added tax and consumption tax will be tried out according to the regulations, and at the same time, the approved collection methods for enterprise income tax will be implemented, and the income tax will be levied at the lowest taxable income rate of 4%, which has solved the industry’s concern that the tax burden will be too heavy due to the lack of input invoices.

  Second, in terms of supervision, the cities where the qualified comprehensive test area is located can be included in the pilot scope of cross-border e-commerce retail import, and the bonded stocking business can be carried out. The imported goods are supervised according to personal use items, and the preferential tax rate is applicable within the trading limit.

  Third, in terms of facilitation, the application of "simplified classification and list clearance" will increase the single transaction limit of cross-border foreign exchange payment by payment institutions, simplify the procedures for the receipt and payment of small and micro cross-border e-commerce goods, and give priority to the establishment of facilitation measures such as the International Mail Exchange Bureau.

Listed company Yabaite’s performance fraud: the fictitious cross-border big bill of 1 billion yuan is from a 20-square-meter store

CCTV News:Recently, the CSRC investigated and dealt with a cross-border financial fraud case of a listed company, which not only bought and sold its own building materials, but also faked transnational business. Moreover, I also want to take advantage of the "One Belt, One Road" east wind to make fake business in Pakistan. However, after cross-border investigation by the regulatory authorities, participating in Pakistan’s projects is completely false, and the company has lied in the annual report.

In August, 2015, Yabate successfully went public by backdoor. The annual report of that year showed that Yabate’s income from the urban rapid transit line project with Multan, Pakistan exceeded 200 million yuan, accounting for 21.8% of the total annual sales. The transnational business of such a large order makes Yabate’s annual report "sparkling". However, the investigators found that this income was problematic.

Investigators of CSRC:As far as the capital chain is concerned, after our investigation, the payback of Yabate mainly comes from the company controlled by Yabate itself, and there are other companies in China, which are not transferred by the Pakistani side at all.

It is understood that the owner of Multan project in Pakistan is Multan Development Agency, with a total investment of more than 350 million US dollars. However, the Multan Development Agency has not cooperated with Yabate at all, and the income mentioned in the annual report is completely false.

Investigators of CSRC:The investigation found that Abbott did not participate in the construction of this project at all. It found an overseas company to forge a false construction contract, but the contract was never fulfilled.

In order to lie, Yabate also directed and performed a "good play" of exporting building materials to Pakistan.

Investigators of CSRC:In the process of building this project, Yabate exported a batch of building materials overseas, and their company claimed that these building materials were used for the construction of this bus station in Multan, Pakistan. However, after our investigation, we found that these building materials were not actually shipped to Pakistan, but were imported back through a third-party company, which achieved the illusion that a fictitious overseas project was under construction in this way.

The CSRC once asked the company and relevant intermediaries to go to Multan to verify the project, but the relevant personnel of Yabate have never been to Multan, Pakistan, and the photos of the construction site are all fake.

73% profit fraud of Yabate

The biggest gain in the annual report turned out to be fraud, and Yabate Company is indeed courageous. However, the investigators found that in addition to counterfeiting this large transnational bill, Abbott had even more bizarre lies.

In 2015, Yabaite transferred the funds to its affiliated companies such as Shanghai Yuanpan and Shanghai Xuanyi by means of false procurement, and then transferred the funds back in the name of sales money through customers such as Shanghai Gui Liang and Shanghai Jiuren, so as to build a capital cycle and forge a "real" capital flow.

In the same year, Yabate forged false export contracts for building materials with overseas companies, transported the goods declared for export to Angola to Hong Kong, and then imported the goods back to China by its affiliated companies.

Investigators of CSRC:He transferred the money from domestic companies to the customs in the form of international trade, and then transferred the money back to China from the customs in the form of import, in this way to forge a real fund.

It is confirmed that from 2015 to September 2016, Yabate inflated its operating income by about 580 million yuan and inflated its profit by nearly 260 million yuan through fictitious overseas engineering projects, fictitious international trade and domestic trade, among which inflated profit in 2015 accounted for about 73% of the total profit for the current period.

In 2015, 73% of Yabaite’s profits were false. Yabaite worked hard to falsify its performance. Why?

It is understood that Yabaite is willing to make fraud, which is related to performance gambling.
